Terms of Service

Welcome to DigitalFlow Consulting. These Terms of Service ("Terms") govern your access to and use of digitalflowconsulting.ca, the DigitalFlow Insider Hub, our growth diagnostic tools, the DigitalFlow Dispatch newsletter, and any related content or services (together, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Who we are

The Services are provided by DigitalFlow Consulting ("DigitalFlow," "we," "us," or "our"), a sales and CRM consultancy based in Halifax, Nova Scotia, Canada. You can reach us at irene@digitalflowconsulting.ca.

2. Using the Services

You may use the Services for your own lawful, business, and informational purposes. You agree not to:

  • Use the Services in any way that breaks the law or infringes the rights of others.
  • Attempt to gain unauthorized access to any part of the Services, our systems, or related networks.
  • Interfere with, disrupt, or place undue load on the Services.
  • Copy, scrape, reproduce, resell, or commercially exploit any part of the Services without our written permission.
  • Use the Services to send spam or to harvest contact information.

We may suspend or limit access to the Services, in whole or in part, at any time and without notice, if we believe these Terms have been breached or to protect the Services and their users.

3. The diagnostic tools, the Insider Hub, and content

Our growth diagnostics, frameworks, articles, and other resources are provided for general informational and educational purposes. They are designed to give you useful insight into your sales and revenue operations, but they are not a substitute for tailored professional, legal, financial, or accounting advice. Any decision you make based on the Services is your own responsibility. Results vary from business to business, and we do not promise any specific outcome.

The DigitalFlow Insider Hub (including insider.digitalflowconsulting.ca) gives you access to our growth diagnostics, resources, and any associated member community. Access to some features may require you to register for an account or join our community platform. We may add, change, limit, or discontinue Insider Hub features at any time.

Accounts

If you create an account to use the Insider Hub, you agree to provide accurate information, to keep your login credentials secure, and to be responsible for activity that happens under your account. Please tell us promptly at irene@digitalflowconsulting.ca if you believe your account has been accessed without your permission. We may suspend or close accounts that breach these Terms.

Community

If you join the Insider Hub community, you agree to take part respectfully and professionally. You will not post unlawful, harassing, misleading, or infringing content, share other people's private information, or use the community to spam or sell without permission. We may moderate, edit, or remove content, and remove members, to keep the community safe and useful. Your use of any third-party community platform is also subject to that platform's own terms.

4. Consulting engagements

These Terms cover your use of the website and tools. Any consulting, RevOps, or fractional CRO engagement is governed by a separate written agreement between you and DigitalFlow. If there is a conflict between these Terms and a signed engagement agreement, the engagement agreement controls for that engagement.

5. Intellectual property

All content on the Services, including text, graphics, logos, diagnostics, frameworks, methodologies, and the DigitalFlow name and brand, is owned by or licensed to DigitalFlow and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable right to access and use the Services for their intended purpose. Nothing in these Terms transfers any ownership rights to you.

6. Your submissions

If you submit information through a form, diagnostic, or other channel, you confirm that you have the right to share it and that it is accurate. You grant us permission to use that information to provide and improve the Services, as described in our Privacy Policy. Please do not submit anything confidential that you do not want us to receive in this way.

7. Third-party links and tools

The Services may link to or integrate with third-party websites, platforms, and tools that we do not control, such as scheduling, hosting, and email providers. We are not responsible for the content, policies, or practices of those third parties, and your use of them is at your own risk and subject to their terms.

8. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, DigitalFlow disclaims all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components.

9. Limitation of liability

To the fullest extent permitted by law, DigitalFlow and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us, if any, to access the part of the Services giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless DigitalFlow and its team from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services or your breach of these Terms.

11. Newsletter and communications

By subscribing to the DigitalFlow Dispatch, you agree to receive commercial electronic messages from us, and you can unsubscribe at any time using the link in any email. See our Privacy Policy for more on how we handle your information.

12. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Services, you consent to those practices.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after a change means you accept the revised Terms.

14. Governing law

These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada that apply there, without regard to conflict of law principles. You agree that the courts located in Nova Scotia will have jurisdiction over any dispute arising from these Terms or the Services.
